I think DJ has an excellent point about law vs. commentary... which parts are "law" in the bible and which parts parables?

I always think a lot of it has to be parables... or do you think that the bears mauling the children story (from II Kings) story that we were discussing the other day is intended to be taken literally?

From secular law, the Maxims of Equity:

Equity will not suffer a wrong to be without a remedy.

Equitable remedies are discretionary.

Equity regards the balance of convenience.

Equity, like nature, does nothing in vain.

He who seeks equity must do equity

He who comes into equity must come with clean hands.

Delay defeats equity.

Equity is equality.

Equity looks to the intent rather than to the form.

Equity looks on that as done which ought to be done.

Equity imputes an intention to fulfil an obligation.

Equity acts on the conscience.

I think many people misunderstand the true notion of secular law, and this unfortunately includes many authoritarians who’s purpose it is to enforce the law.

Secular law is not about judgment at all. At least not judgment of the individual. On the contrary, the so-called “judges” are supposed to be impartial mediators who oversee and assure equity. Their title is actually misleading and inappropriate.

Unfortunately, judges are seldom impartial mediators who are seriously interested in assuring equity.

Religious law on the other hand is indeed based on judgment of the individual. By its very definition it’s bigotry via a deity. laugh

Seriously, that’s what religious law is. Religious law is dictatorship where the deity is the dictator. Equity need not be a part of that.

So secular law and religious law are entirely differnet concepts altogether. Unfortunately few people realize this. Even those who work in the field of law mistakenly view the law as a form of religious judgment, This is crystal clear by the simple fact that the penalties of the law are indeed referred to as “punishments” such as in “capital punishment”. It’s really not the purpose of the law to punish anyone, but rather to serve penalties based entirely on equity. No moral judgments are necessary.

In fact, these clear differences between secular law and religious law is precisely why religion should never be the basis for laws enforced by men. Man’s laws must be secular with equity as their basis. To allow religion to be the basis of law would cause the legal system to become even more judgmental than it already is. Mankind really has some work to do to remove the judgmental aspect of law from the legal system. Unfortunately this isn’t deemed to be high priority in society today. In fact, we often hear people proclaiming how a person ‘deserves’ certain punishments. But that’s really not the basis of secular law. Equity is supposed to be the basis of secular law.

Oh well, … just another area that mankind needs to work on.

For clarification, are we refering to a secular govt. and why we have one, or are we talking about govt. being seperate from all religions to make sure that every religion has a fair standing in the laws of the govt?
