today a friend of mine asked me if in the state of new york if u have a child to a blood relative can ur child be taking away from u? and can u be put in jail? if anyone can help let me know.

well you see they are no longer together and he lives they live in different states. He is her half brother. They have the same father but different mothers and she is to embarressed to ask anyone but she is scared of losing the child.

actually if the child is not going to have any health problems or deformities than i don't think there is too much to worry about, no one can really do anything if she doesn't tell them the child is a product of incest

i don't think they'll take the child away under those circumstances but she's probably looking at a very long time of social services visits and councling if the state finds out. not to mention other things. depending on her age and her age there could be molestation charges, child endangerment, probably a whole list of things. best bet would be to keep the guy out of it completely and just pretend she don't know who the father is. i know thats crappy to do to a guy especially if he wants to be involved but it might be best for everybody that way.

well she lives in new york and is getting help from social services so they already know and thats what she is worryed about

nope incest is not legal. closest relative that is legal in any state is first cousin, and thats only in 1 or 2 states (southern no less) thats where the child endangerment and those kind of charges are going to come into play.

social sevices probably wont take it away, but they'll push for counsiling and regular visits and such.

who knows, one of my ex's, her sister made out with guy, little more then make out (she blew him) and found out it was her cousin a week later at a family reunion. the sad part was he knew she was his cousin while she was doing it.
