We used that police video in my criminology class for a discussion on police procedure. We were also given copies of the incident report.

She didn't comply to his command (for handcuffs) and she was tazered.

The topic of debate was whether the officer felt he was in fear of his life to use non-lethal force.

His report stated she rushed him and threw a "punch". The legal definition of assault is the ATTEMPT to hit whereas actual battery is the connection of an assault.

Examples: ASSAULT - throw a punch or spitting but missing. BATTERY: squirt someone with a hose (during a verbal) or spitting on them and it lands.

I sided with the officer after reading the police report. Even though she was a 72 year old woman, she did not comply and she "dared" him to tazer her after she squared off to him and threw a punch. She was a wild and wily 72 years old! Mouthy and all about being trouble! :laughing:

In this day and age of police shootings and other bodily harm that befalls our officers, I don't think anyone is above the compliance law regardless of age, gender, being with child, or handicapped.

When an officer gives a lawful command -- our reaction as citizens is to comply (period). The officers are simply following the law -- and the courtroom is here we dispute, defend, and seek justice. I am not saying the system is perfect -- not by a long shot -- but I staunchly support the officers in the field. winking

Please don't get tired of hearing this: I am almost done with my master's!!! 16 more units after this semester! :banana:
I will be a criminologist and court expert witness during trials!!! Hmmm, kind of scary!! scared :laughing:

watching the video, the officer did what he had to do, she was non compliant.

Hey you are big enough or bad enough to go off on a cop I don't care how old you are you got to know it is going to be a bad day.

In all fairness didn't see the video but I know some "Seniors" that can be real "fighters" and they don't care if they get hurt in the process. Or hurt a cop. They think they won't go to jail. Or they count on the fact the cop will hesitate long enough to let them get a few more licks in.

Tazers hurt but it is less leathel than breaking bones on a senior that often will cause a compound fracture. Cops know if they break bones it can kill a senior or send them to Skilled Nurseing Facilities that in many cases are worse than jail

Unfortuneately too some seniors are known as "frequent flyers" with the police. The officer on scene may have known just how violent the woman was. Seniors can and do bite, spit, gouge, headbutt, stab, or bash with anything they can get a hold of with a strength you would not even dream was possible. Everyone wants to go home with as few injuries as possible.

there is the article. for the record...my grandmother is 86 (back surgeries, mastectomy, minor heart attacks and stroke and still mows her 2 acres of grass and pulls weeds) even though she'd never act the way this lady did....she is a force to be reckoned with if she did decide to do this.

plain and simple...no one knows what it's like unless you have been in the situation. the lady could have sped away in the car....causing an accident and hurting herself and others or running over the cop. if he tried to subdue her and she fought..people would see it as police brutality. sometimes it's a no win situation. there are good and bad in every profession but not all in a profession are good or bad

This for the folks who do not get it is a person who will defend THE BLUE WALL..till it hurts you...The lawsuit was settled for 40,000 dollars when the county was sued. What price do you put on apprehending a 72 year old lady.If the police officer was so darn proper and the police union believed that ,then why was the lawsuit settled and not fought.It is stupid to say he was right and then not fight for his right to do it again.
I would like to know the history of this county when it comes to excessive force,and alot of other questions.What is her driving record and had she ever even had a cross with the law.
And for those of you who commented that we should have fear of what she might have done had he let her go.She may well have gone home and they could have picked her up there with even more backup ..And for those of you touting how strong the elderly are ,I laugh at the logic...Most elderly are on some sort of medication and would be prone to heart attacks..What about them?Do doctors recommend shock therapy for the elderly...NO NO NO!But it is okay for the police because they have no responsibility if she dies..She resisted so she deserves it seems to be the consensus here and it is a shame folks get brainwashed into this thought pattern..Shock em till they conform aye...........
