Topic: 72 year old woman getting tazered!? | |

yeah you're right
woulda been better to just shoot her |
|
|
|
doesn't it cost more to fight it out in a trial????
|
|
|

What a sad statement...Do you believe it was right to pay or not...and the message to the next officer is what?
Loser pays costs in most states so the arguement of cost is not an issue. |

well she should have listened! Clearly she was mouthing off an trying to get out of the ticket. Just because she is older don't mean she can break the law an get away with it!!

We used that police video in my criminology class for a discussion on police procedure. We were also given copies of the incident report. She didn't comply to his command (for handcuffs) and she was tazered. The topic of debate was whether the officer felt he was in fear of his life to use non-lethal force. His report stated she rushed him and threw a "punch". The legal definition of assault is the ATTEMPT to hit whereas actual battery is the connection of an assault. Examples: ASSAULT - throw a punch or spitting but missing. BATTERY: squirt someone with a hose (during a verbal) or spitting on them and it lands. I sided with the officer after reading the police report. Even though she was a 72 year old woman, she did not comply and she "dared" him to tazer her after she squared off to him and threw a punch. She was a wild and wily 72 years old! Mouthy and all about being trouble! In this day and age of police shootings and other bodily harm that befalls our officers, I don't think anyone is above the compliance law regardless of age, gender, being with child, or handicapped. When an officer gives a lawful command -- our reaction as citizens is to comply (period). The officers are simply following the law -- and the courtroom is here we dispute, defend, and seek justice. I am not saying the system is perfect -- not by a long shot -- but I staunchly support the officers in the field. Please don't get tired of hearing this: I am almost done with my master's!!! 16 more units after this semester! I will be a criminologist and court expert witness during trials!!! Hmmm, kind of scary!! This for the folks who do not get it is a person who will defend THE BLUE WALL..till it hurts you...The lawsuit was settled for 40,000 dollars when the county was sued. What price do you put on apprehending a 72 year old lady.If the police officer was so darn proper and the police union believed that ,then why was the lawsuit settled and not fought. It is stupid to say he was right and then not fight for his right to do it again. I would like to know the history of this county when it comes to excessive force, and alot of other questions. What is her driving record and had she ever even had a cross with the law. And for those of you who commented that we should have fear of what she might have done had he let her go.She may well have gone home and they could have picked her up there with even more backup ..And for those of you touting how strong the elderly are ,I laugh at the logic...Most elderly are on some sort of medication and would be prone to heart attacks..What about them?Do doctors recommend shock therapy for the elderly...NO NO NO!But it is okay for the police because they have no responsibility if she dies..She resisted so she deserves it seems to be the consensus here and it is a shame folks get brainwashed into this thought pattern..Shock em till they conform aye........... I have not said she was not wrong but Winning a civil lawsuit does not mean guilt in a criminal case. Many times the civil suit is 'make it go away money' or party politics. Yes, that county has a reputation for being heavy handed. This was a way to hush 'em up. Maybe the people in that county should start abiding by the laws. As a side note, if it was my mother or grandmother, they would have sat in jail. I would have been embarrassed. I was brought up to take responsibility for my actions and I expect my family to do the same. People on medication are more of a threat to anyone trying to contain them because they are not in control of their facilities. I do not believe "medication" is a potential argument for her actions. If she is a heart patient, as you suggested for some elders, then she shouldn't cause herself excitement. A person can’t claim injury when they bring it upon themselves especially if they are under treatment and KNOW they have a propensity for risk. As I said, the system is not perfect, but she was in the wrong by not complying with law enforcement. A quote from Silence of the Lambs: “It puts the lotion on his skin or else it gets the hose again". At least people should learn by repetition and consequences!! He warned her HOW many times to comply???? WTF does it take?? I'll bet she was not the kind of mom or grandmother to take flack from her kids. Why would she not understand his orders the first time? It's ridiculous. Let's hold the hands of all the troublemakers and just let the country live lawlessly!!! |

Oh my ,you amaze me defending this action...My first question is why we hire Officers who can not defend themselves from bodily harm from a 74 year old woman without the use of what could be deadly force. For this officer to claim he was in harms way would be ludicrous to say the least considering his size.So what we have here is a ego out of control.Hers was surely not right and I am not defending her.I am however appauled at your defense of the tazer use.It is not an officers job to dole out punishment, that is for the courts and he had her tag on film...How hard would it have been to let her go home...Ask yourself what was the harm in that...Bring a lady officer with him and serve her papers at home..Same result (she goes to court)and the county would save 40,000 dollars.
You may want to read about the tazering of cripples ,children and pregnant women before you applaude the use ...We see it happen on an all to often basis and we do not care because it is not our relative ..That to me is a sickness and you seem to defend it.Do a Google search on tazers used on elderly and children and worst of all ,the pregnant...It will make you sick to see the abuses. |

I am getting my master's in criminology and police procedure is part of my study program (as I prefaced my original post). I am no stranger to both civil and criminal law. We disagree; I don't plan to change you mind and you will not change mine. "Oh my ,you amaze me defending this action". You can stop being 'amazed'. I don't defend people who feel they are above the law due to gender, age, handicapped, etc. She threw a big 'ol hissy fit and I do not feel badly. She had a choice to comply. I'm tired of the "woe is me attitude" in this country. Enjoy your night. |

So you believe in ruling by fear? Not I..I believe in respecting our police not fearing them. What does a county have to hide from a lawsuit of this nature..Go away money..So the precident in that county is now...tazer the heck out of em and we'll just dole out more cash when needed.Or just shoot em?Take your choice but I think right is might and if the county or the officer was so right then why not stand up proudly and fight the case tooth and nail. |

See what blame gets us? Endless back and forth. In my opinion , they BOTH made bad choices. Hers was not to comply, his was to use unnecessary force on a grandmom. Kind of reminds me years back when some citizens decided to protest the LAWFUL demolition of a site. A female stood in front of a bulldozer, the female got bulldozed. People said the driver must have been an animal, others said the girl must have been unreasonable..I said, both made a bad choice. |

Instead, she got aggressive and nasty back. So she got what she deserved. |

This busts my chops..Sometimes when I read a post ,I go check out the profile to see if there is consistency in thought. In this case I see you say you have and I quote your profile "excessive empathy toward others" Give us a break or define empathy.Bad choices !!!!I find that you are somewhat calloused if you believe what you wrote. A bad choice is not running someone over with a dozer..That is a brain gone dead and an ego out of control..And the driver earned money doing such an act..Please rethink your post and apply it to your children or at least read about school tazering and get back in touch. |

Miss Dancer,
It is a love of animals that we have in common.I rescue them also..So let's apply your thinking to one of them...You rescue a dog and he has a bad day because he has been left to run the road and is scared and has a hurt paw and is hungry..You go to check his paw and he snaps at you.Do you treat that dog with love or get out your cattle prod? I know this is an apples and orange arguement but please think about others plights before you condone the action of Zapping someone..These tazers are not for use on the elderly ,children or folks in hospital beds strapped down and yet you will see that there are cases that all of this has happened. At what point do you draw the line? |

Miss Melody,
You write.. Examples: ASSAULT - throw a punch or spitting but missing. BATTERY: squirt someone with a hose (during a verbal) or spitting on them and it lands. My answer...It stuns me to see the amount of women defending this type of action..The use of tazers on a old lady.It is deplorable...After you all fought to get domestic abuse laws ,you stand up for this Officer.. Let us try this...Hypothetically we are a couple...you spit on me and I tazer you. OR You throw a punch at me and miss and I tazer you..Now before you did either action ,I warned you ....do not do it and you proceed..Do you still believe that I should be prosecuted? Or is that a rule only for the police? |
