I think kavanaugh should sue her for slander. She isn't testifying because there is nothing to tell. To me she looks like a nutcase looking for attention. Who goes to a therapist for a rape that didn't happen?

There was no publication of a lie. it was a private psychologist session and a private letter.
and there is no way to prove it is untrue. So a libel or slander suit would be unlikely. |

however, with witnesses or corroborating statements it can be found beyond a reasonable doubt that it did happen. Criminal cases are one on such circumstantial 'evidence' all the time. But the point is not even if it was a crime, but rather the character it reflects upon a potential SCOTUS, and only IF such behavior is not an isolated event but a trend throughout his life. |

It looks like it's her that can't give details. Sounds like you've found him guilty already, of a crime he didn't commit. She needs to testify and then let the man defend himself. There is nothing the FBI can do. It's not there job to investigate when it's clear there wasn't a crime. I doubt witnesses remember much from 35 years ago. The man has lived a good life and is raising a nice family. She needs to testify or shut up.

A good part of this is that dippy attorney she has. Debra Katz doesn't want Kavanaugh appointed, so she is making outlandish demands. This liberal dem is showing how power hungry they are. Some of the basic tenants of how our court system operates, is being thrown out by this woman. Alan Dershowitz said it best. She wants this put into a kangaroo court.
If Kavanaugh was suspected of murder,Katz would strap him into the chair, and throw the switch. Reminds me of the persecution of the jews in Nazi Germany. They were jews, exterminate them. |

Women already know drunk men will be at these parties. It's their choice to go. Going into a room alone with a man at a party gives him expectations. Since there was no rape, there is no crime.

He didn't rape anybody. For a horny drunk teenager to try to have sex with a girl who has left the party and gone with him into a room alone, is completely normal. For her to be seeing a shrink about a rape that didn't happen, means she is a nut. Witnesses are already saying that they don't believe her. It was on CNN this morning. She won't even agree to testify. She knows holes will quickly be poked in her story. That's why she wants a FBI investigation. She wants to ruin the man's career before he can be proven innocent

So he tried to take her clothes off but couldn't. She fought off two men trying to rape her. She said nothing but mad 35 years later. It's clearly more about politics than a party. She doesn't even want to testify. That speaks volumes.

As a teenager I wasn't allowed to go to those types of parties. We have names for the types of girls who did. She wasn't walking down the hall of her high school or at the mall. She chose her environment. She wasn't raped. I don't see how k believes women shouldn't be safe from that environment. The were a lot more girls who chose not to go, than ones who chose that environment.

As a teenager, I wasnt allowed to be 'falling down drunk' or drink at all for that matter. I also was not encouraged to engage in calling other kids names.
I was taught that what was done in the dark may EVENTUALLY come to the light. so, thankfully, the accuser didnt decide to eventually try to be in a position to rule over other accusers, but the accused did. That is about relevance, not about what people should or should not have done. If he did nothing wrong, let him explain himself. It is part of the scrutiny a SCOTUS candidate goes through. If he made a teenage isolated mistake, let him explain that too. I hope that he wont be judged on isolated actions but on his historical tendency for respecting women, as he will be expected in the position of SCOTUS to uphold their rights along with everyone else. |

It's not victim blaming. Of course she was friends with people throwing the party. There are reasons people choose not to go. Teenagers go to get drunk and have sex. She wasn't raped. She isn't a victim. It's politics.
You just made the point that she had brothers to tell. I assume they were there. |

Being victim is still not the point.
The point is having the character for the JOB. Im sure if conservatives were to find that a nominee had gone around calling white folks crackers and refusing to socialize with them, they would take question to them being a SCOTUS judge who would be in position for the rest of their life to make decisions regarding the rights of plaintiffs who were white. even though such racist speech is not against the law and no CRIME was committed. This is along the same lines. Someone who is SCOTUS will make rulings over all types of people from all walks of life, and their history of bias against any of those groups needs to be considered. It should come with the job because it is guaranteed for a LIFETIME once they get it at a taxpayer rate of a quarter of a million dollars a year, money that may come from some of those very types of taxpayers for which the bias is shown. so its RELEVANT to place high scrutiny of a SCOTUS NOMINEE in regards to their respect for other people's rights or their bias against other people. |

people who escape being shot are still traumatized, even though they didnt get shot. people who escape being raped are still traumatized, even if they werent raped. many young girls dont believe people will believe them, many dont want to put their loved ones in a position to do something stupid because they know they WILL believe them. none of that though, is relevant to how young men should behave or the character that is to be expected of a SCOTUS judge. If there are holes, let the candidate expose them. If not, let that be brought to light too. So far, she has going for her that she disclosed this to a medical professional years earlier, and that the friend in question who was with Kavanaugh has stated before about their history of getting falling down drunk together. |

As a survivor, it is refreshing to see people understand all the different things that go on in a person's mind during and after these types of events. I initially thought this was just a guy trying to get fresh, until I read about the allegation that she was thrown on a bed with a HAND PLACED over her mouth ... I can imagine it because Ive been through it (minus the bed). Thank God I also got away, but all the 'what ifs' that happened during that altercation did not just go away and I certainly would take issue with any of the assailants showing up in the news as a SCOTUS candidate. I remember a similar high school incident, (near a park) which I told no one about. Why? because I got away unscathed and because I didnt want my brothers to go off and find the kid and do something stupid. and because as a teen, I wasnt sure much would be done about it besides a smack on the hand after which I would STILL have to be in school with the creep. I dont know what happened with the accuser, but based on her account, I do know the feeling of fear and violation that follows. |

Being at a party that's unchaperoned with underage drinking isn't having a good reputation. Those girls are known for being party girls. She wasn't raped and isn't a victim. She didn't tell her brothers because she was known for being a party girl.
