protesters have the right to assemble & are in fact defacto stakeholders in public lands as is any CITIZEN in the U.S. So interference with a legal & peaceful gathering in protest is arguably a concern and probably illegal.

It is the BLM's job to balance the varied entities with an interest in the use and disposition of public lands. There is no reason that natural gas fracturing should prevent grazing, or harm tortises or cattle or horses. There will be an environmental impact because they will need to build roads. The well pads themselves will not take up much space. Water quality and earthquakes are the real issues. And, fracturing should be put on hold until further studies are done/ information is gathered regarding existing concerns in other parts of the country (where i live in Ohio, for instance) before fracturing is continued. In fact public land use requires environmental impact studies. The true focus should be on obtaining that/ making sure it is completed and disclosed in full. Thankfully we have the right to request an impact statement and comment in the federal administrations comment period. Those things are probably at least as useful as protests. Facts, not reactionary vomiting, will have an influence.

I really do not see how they can fracture out west. It takes millions of gallons of water. Where fracturing occurs out west they use a higher percentage of recycled water than we do here, and Ohio needs to look at that/ adopt that practice. Water is not infinite and no single entity should be permitted to compromise clean water interests that affect the rest of us.

My impression was that the bundy grazing issue had to do with wild horses. I do side with the BLM on that matter and agree within their jurisdiction on BLM lands. There are records that record the boundaries. Both Mr Bundy and the BLM need to observe those boundaries. No one is "automatically" guaranteed unlimited access to public lands, especially if it is determined by their legal administrators that the use compromises the interests too greatly of other stakeholders. Just because he has always "done it this way" is not a good enough reason to continue any particular practice on public lands for ANYONE (not just Bundy). We all eat too much beef anyway.

This has nothing to do with a tortoise. In fact, the Bureau of Land Management has been killing those tortoises themselves due to lack of funding for the conservation center!

http://www.kingsnake.com/blog/archives/1561-BLM-to-kill-hundreds-of-desert-tortoises-as-its-conservation-center-runs-out-of-money.html

A far more likely reason BLM wants that land is that BLM has been selling fracking leases to oil companies in that part of the state!

BLM sells 29 oil, gas leases in northeast Nevada

RENO, Nev. (AP) Buyers snapped up 29 federal land leases totaling more than 56 square miles in a northeastern Nevada area.

This could become the state's first oil shale fracking site.

U.S. Bureau of Land Management geologist Lorenzo Trimble tells the Las Vegas Review-Journal the Elko County oil and gas leases sold Tuesday for $1.27 million to six different companies.

The auction took place in Reno. The leases are near where Houston-based Noble Energy Inc. wants to drill for oil and natural gas on 40,000 acres of public and private land near the town of Wells.

The Review-Journal reports the project would be the first in Nevada to use hydraulic fracturing, or fracking, to extract oil and gas from shale deposits.

The BLM is conducting an environmental review of Noble's proposal.

BLM does a crappy job at caring for the Mustangs.

The next auction they put on here, I'll get pictures and post them for all to see the condition these animals are in.

They'd be better off processed for food.

No one puts any attention to the damage fracking does.

Anywhere it's done, antifreeze and other chemicals work their way int aquifers.

Now, if it was just liberals being poisoned by frackig, I say go for it. That's not the case. Humans are affected also.

Liberals have been fooled by the govt's desert tortoise cover story as they were intended to be fooled...myself, I look at the BIG PICTURE; i.e. geo-politics.

Replacing Russian Gas Deliveries with US Shale Gas? Washington Lies to the EU

The White House and State Department have engaged in brazen lying to EU governments regarding the ability of the US to supply more than enough natural gas to replace Russian gas deliveries. Recent statements by US President Obama and Secretary of State John Kerry are so patently false that it betrays an incredible desperation in Washington over the situation in Ukraine versus Moscow. Or it suggests that Washington is so out of touch with any factual reality it simply doesn't care what it says. Either way, it suggests an unreliable diplomatic partner for the EU.

http://www.globalresearch.ca/replacing-russian-gas-deliveries-with-us-shale-gas-washington-lies-to-the-eu/5377358

The BLM is selling oil leases across the west to the fracking companies. This may well be the real motive to drive Cliven Bundy off of his ranch, and we are now getting word that similar BLM moves against ranchers are happening not only elsewhere in Nevada but in Colorado.

So it looks like the US Government is going to turn the nation over to the frackers so they have enough gas to move their war agenda forward.

Harry Reid's Connection to Bundy Ranch Siege

As some may be aware, the Bundy Ranch in Nevada is having 500 plus head of free range cattle that have been fed on desert BLM land seized by the government. This is a long standing decades old dispute that pits the Bundy family, who have ranched this land since the 1870s, against a literal army of BLM SWAT forces supposedly there to protect desert tortoises.

Our purpose here is to show how this siege must all eventually be linked to Senator Harry Reid, who literally controls everything that happens in Nevada. I wrote the only biography of Harry Reid (more below) which goes into his history of shady land dealings and use of the BLM. The best leverage the Bundys have is not against the BLM, but by making corrupt Harry Reid the focus of media attention. Because this is breaking, I will be updating this page continuously as I put information together, lots more to come.

Things are heating up!

I believe in a citizen militia, I also believe our govt is out of control and overstepping its authority. But this could spell disaster!

To the govt who holds a hammer, everything is a nail, and like Waco, Ruby Ridge, Wounded Knee, Kent State and so many other occurrences, the govt can be expected to respond by inciting violence to justify deadly action!

One can only hope the Sheriff and the Governor won't let it go that far...... but their actions so far (inaction by the sheriff, and only words from an absent from the scene politician [Governor]) don't give one much hope of the peaceful solution either of them could bring immediately if they would just stepped up to the plate and do their elected jobs!

I also just came across this little tidbit.... haven't confirmed it yet, but it sounded interesting and probable....

Killing or selling the cattle would put a whole new slant on this case making it an illegal action on the part of the BLM!

BLOCKBUSTER: Straight from a rancher's mouth

I live in SW Utah. I grew up on a ranch less than 100 miles from the Bundy's ranch. My father knows Cliven Bundy. I know Cliven's son Ryan. This is not a hoax, it is an action of force by the BLM.

The BLM was going to sell the cattle at one of the smallest cattle markets in Utah. No cattle markets in Nevada would take the cattle without a properly signed brand inspection (which the BLM cannot obtain without Cliven Bundy's signature). The BLM paid the owner of the Utah cattle market $300,000 to do the sale ('R' Livestock Connection in Monroe, Utah, owned by one Scott G. Robbins, according to the Utah Business Entity Search). Utah Governor Herbert stepped in and forbid them from bringing the cattle into Utah without the legally required health and brand inspections (which again, require Bundy's signature) and that no feral cattle are allowed to be imported at all (per Utah statute). Because Bundy claims ownership over maybe 350-500 head of branded cattle, the other 500-700 estimated head of cattle would all be considered feral. BLM officially backed off, but we suspect they are still secretly shipping them through Utah without any permission to do so, to "private" buyers in Colorado. The contract cowboys that the BLM hired to do the roundup are from Sampson Livestock in Meadow, Utah (traitors one and all).

From what I understand, Cliven Bundy owns both the Water Rights and Grazing Rights to all of the land where his cattle run. If Bundy failed to use them, the Grazing Rights would revert to the BLM and would be retired, while the Water Rights would revert to the State of Nevada, likely to be sold to the highest bidder (which would probably be a bidding war between mineral companies that are behind this action with the BLM and the City of Las Vegas which is thirsty for water and has had multiple attempts to buy water--through eminent domain from Utah farmers and ranchers--from Utah, which were all blocked by the Utah Legislature and Utah Governor Herbert). Chances are, the BLM has already filed a claim on the water rights so that they can sell to the highest bidder (instead of the state) and are trying to get the cattle off to show that Bundy cannot use the water beneficially (much like what the US Forest Service and BLM both tried to do to Wayne Hage).

http://www.jimstonefreelance.com/fromaranchersmouth.html

And this! About the "legal water rights" to the Bundy Ranch which the Bundys' hold legally!

BLM Caught Illegally Destroying 100 Yr Old Water Tanks

http://www.youtube.com/watch?v=DYszv9-wMbs&feature=youtu.be

If this is all true the BLM has FAR overstepped their legal authority in this action, and taken it to the point of criminal illegality!

During the 19th century: Cattle Rustling was a hanging offense in Nevada; might be interesting to see if capital punishment for cattle rustling was ever repealed in the State of Nevada.

Respondeat superior

[Latin, Let the master answer.] A common-law doctrine that makes an employer liable for the actions of an employee when the actions take place within the scope of employment.

The common-law doctrine of respondeat superior was established in seventeenth-century England to define the legal liability of an employer for the actions of an employee. The doctrine was adopted in the United States and has been a fixture of agency law. It provides a better chance for an injured party to actually recover damages, because under respondeat superior the employer is liable for the injuries caused by an employee who is working within the scope of his employment relationship. The legal relationship between an employer and an employee is called agency. The employer is called the principal when engaging someone to act for him. The person who does the work for the employer is called the agent. The theory behind respondeat superior is that the principal controls the agent's behavior and must then assume some responsibility for the agent's actions.

An employee is an agent for her employer to the extent that the employee is authorized to act for the employer and is partially entrusted with the employer's business. The employer controls, or has a right to control, the time, place, and method of doing work. When the facts show that an employer-employee (principal-agent) relationship exists, the employer can be held responsible for the injuries caused by the employee in the course of employment.

In general, employee conduct that bears some relationship to the work will usually be considered within the scope of employment. The question whether an employee was acting within the scope of employment at the time of the event depends on the particular facts of the case. A court may consider the employee's job description or assigned duties, the time, place, and purpose of the employee's act, the extent to which the employee's actions conformed to what she was hired to do, and whether such an occurrence could reasonably have been expected.

http://legal-dictionary.thefreedictionary.com/Respondeat+Superior

Might just be; Harry Reid has committed a capital offense in the State of Nevada.

For anyone not familiar with what is happening right now on the Bundy Ranch in Nevada please google it!

It seems the Feds, under the banner of the BLM, are trying to oust ranchers off of state owned grazing lands they simply manage.

It is rumored these actions are simply to remove the ranchers from these lands to allow for corporations to come in and start fracking..... not about the turtles, cattle or grazing rights! It's about oil companies and their political profiteers lining their pockets at the expense of the ranchers, destroying the ranches and businesses, and seizing their homes and lands for corporate profit.....AT TAXPAYER EXPENSE!! The simple theft of the ranchers cattle is costing taxpayers around $3 MILLION dollars already!

They say it is to "protect the desert tortoise" that these actions are being taken, confiscating cattle, arresting protesters after tazing and beating them, placing snipers on location, motion detectors, radar, helicopters, and hundreds of heavily armed law enforcement... but it seems there is a FED action in progress to euthanize hundreds, maybe thousands, of these turtles even while this is taking place!

Have we had enough of this BS yet?

The POTUS will involve himself in the Zimmerman trial which police found no evidence to prosecute on originally, inflaming racial tension across America, but when rights, freedom and corruption take place against a whole town or state of people..... he remains silent..... as he did with the IRS case against conservatives, or as in the lies he told to cover up the Benghazi attack before the last election..... blaming a youtube video when he knew that wasn't the case from day one..... but his re-election campaign was based on his statements of Al Qaeda being "on the run" under his admin

Typically I disagree with you but I don't on this, this smell's of Obama's heavy handed approach. One phone call by him and this could be all done. (WACO was justified, Ruby Ride was overkill but justified being Weaver was an armed White Supremacist who was selling sawed off shot guns and refusing to appear in court, it's funny if they listened to the FBI "Profilers" I believe both situations could have had different outcomes.

Needless to say Obama's not a popular guy in Nevada, especially in the area this guy is in. He only is popular in the Democratic stronghold of Las Vegas and a small portion of Washoe County and these people that are gathering to protest I guarantee are looking at the Federal Agents as an arm of Obama and this could turn into a very, very bad situation.

I am ashamed of our Governor Brian "spend it all" Sandoval for not getting involved and helping to get this issue resolved. Of course he is a RINO and is Obamas little b*$%^.

I respect his military service as I do all vets (excepts a$$wads like the Fort Hood shooters and Navy Yard shooter) but he is a walking pompus racist a$$.
