I am adamant in my assertion that you should *not* file anything. You've
already got what you want and I think filing motions will only serve to
anger him and create an atmosphere for retribution.

Filing in MD will also create their having jurisdiction so even *if* you
get his *approval* to move, which will be needed once he is legally the
father and you've COs in place, you'll have to go to MD for every
revision of the CO.

Changing jurisdiction is hard to do; are you willing to travel?

i totally agree with her...of course, we aren't lawyers...so you need to
get legal advice where you live, BEFORE he takes action.

i'm actually cringing...

of course, in my state...i have full custody, being as we weren't
married when my baby was born...even better, i was married to someone
else! so she has a legal father who (thank goodness) isn't likely to
show up and assert his rights.

ask what would happen if you got the heck out of there, in addition to
whether you should file anything or not. and keep in mind...any lawyer
would wish for a retainer, so he MIGHT lean a little more towards
filing.

These questions and answers are helping me too but i was married still
am but have been separted for 1 1/2 years now and have had my girls the
whole time. no court papers. but i did find out that. posetion at time
of court can be a problem so dont let him know your going to court til
you have all the papers ready. and keep you children away where he dont
know how to get to! they can go on__ vacation with your permition at any
time you want! I just got the first lawer to give me a call ill know
more later, and ill pass on what i find out! He is going to hit the
roof! i'm almost scrared........almost!

oh boy was i right. he went balistic. and i still dont have any
answers. i know he was served friday right before the holiday weekend.
he is already threatening to get (take) my girls away. he dose lie easy
but i dont know what to believe. i dont think at 430pm he was able to
get a lawer like he sayson the friday before a holiday. if anyone know
Illinois law about him taking them for visitation when he threatens to
take them from me. i dont belive they will be able to come back. i
believe he would keep them. in the past 14weeks he has only given me
300$ and are aggrement was for 150$ per week. that started 11/2 years
ago but he allways gave me cash. he gave me nothing. i know that
childsupport ands visitations are separte and you cant hold the kids
back from seeing their father but i belive they and i are in danger....i

with him and left to my brothers but i'm back home now......what if

if you have no agreement then do not let him in your house.once you open
the door all bets are off.i wouldnt let my child out of my sight till a
custody agreement was in place.i knew he would keep him and without the
agreement the police's hands are tied.

my lawer did file in court and my soon to be x was served on friday
afternoon about400pm with the papers. his threat came sat morning 821am

same as me.my ex talked smack too.he will calm down.he is just
threatening you with the kids cause he knows that will hurt you.Dont
take the bait. .

I just went through this in MO. I was told by my lawyer that nobody has
custody over her until it's established in court including me. We were
not married and he was listed on the birth certificate My advice is to
get a lawyer and get it legally done. If he doesn't respond or get a
lawyer you'll get everything you ask for. At least I did.

I know in minn I had to file to get custody as we were not married. Best
move I ever made.

Isnt it a real shame and it should be a crime that abusers are allowed
to keep up their abuse thru the family courts with threats of custody? 9
out of 10 of these men dont want custody. Its just another form of
abuse. I know sadly as i have gone beyond bankrupt thanks to mine. The
best thing you ladies can do is lawyer up, get a good one to begin with
and close this mess straight up the FIRST ROUND IN COURT. Do NOT allow
them to bully or frighten you do to lack of a marital contract. You have
custody and until a JUDGE ORDERS DIFFERENTLY just relax. Go to your
state websites and look into the laws for your state. In my case its
finally OVER. I hired the best this last round and its finally OVER.

In my state. you have to go to court to file for custody but if the dad
hasn't seen him & he lives with you, then you will have no problem in
court. Does he pay child support?

Barbie, you are so right about the fact that he is only doing this to
hurt me. He doesnt really want the responsablity of taking care of a
child.

I hope you get child support. It is so hard to do things on your own.
I don't know about anyone else but we're suppose to get child support
and we don't see a penny and nothing is really done about it.
