Police Get The Wrong House In Galveston, Allegedly Assault 12-Year-Old Girl

It was a little before 8 at night when the breaker went out at Emily Milburn's home in Galveston. She was busy preparing her children for school the next day, so she asked her 12-year-old daughter, Dymond, to pop outside and turn the switch back on.

As Dymond headed toward the breaker, a blue van drove up and three men jumped out rushing toward her. One of them grabbed her saying, "You're a prostitute. You're coming with me."

Dymond grabbed onto a tree and started screaming, "Daddy, Daddy, Daddy." One of the men covered her mouth. Two of the men beat her about the face and throat.

As it turned out, the three men were plain-clothed Galveston police officers who had been called to the area regarding three white prostitutes soliciting a white man and a black drug dealer.



All this is according to a lawsuit filed in Galveston federal court by Milburn against the officers. The lawsuit alleges that the officers thought Dymond, an African-American, was a hooker due to the "tight shorts" she was wearing, despite not fitting the racial description of any of the female suspects. The police went to the wrong house, two blocks away from the area of the reported illegal activity, Milburn's attorney, Anthony Griffin, tells Hair Balls.

After the incident, Dymond was hospitalized and suffered black eyes as well as throat and ear drum injuries.

Three weeks later, according to the lawsuit, police went to Dymond's school, where she was an honor student, and arrested her for assaulting a public servant. Griffin says the allegations stem from when Dymond fought back against the three men who were trying to take her from her home. The case went to trial, but the judge declared it a mistrial on the first day, says Griffin. The new trial is set for February.

"I think we'll be okay," says Griffin. "I don't think a jury will find a 12-year-old girl guilty who's just sitting outside her house. Any 12-year-old attacked by three men and told that she's a prostitute is going to scream and yell for Daddy and hit back and do whatever she can. She's scared to death."

Since the incident more than two years ago, Dymond regularly suffers nightmares in which police officers are raping and beating her and cutting off her fingers, according to the lawsuit.
Griffin says he expects to enter mediation with the officers in early 2009 to resolve the lawsuit.

Both the daughter and the father were arrested for assaulting a peace officer. "The father basically attacked police officers as they were trying to take the daughter into custody after she ran off."

Also, "The city has investigated the matter and found that the conduct of the police officers was appropriate under the circumstances," Helfand says. "It's unfortunate that sometimes police officers have to use force against people who are using force against them. And the evidence will show that both these folks violated the law and forcefully resisted arrest."

Oh my god thats just aweful... and these cops are gonna get away with it... shameful.

figures, Texas, Louisiana and Mississippi have the most ignorant redneck inbred stupid cops in the nation that I've seen. I've worked with them and around them in the past, many do not deserve to work in that capacity. If they do wrong, it is always attempted to cover it up and they will side with their officers even when wrong in order to keep a lid on things.

Cops here will tell you right away, that to protect and serve is not what they do, and it isn't really, they just respond to calls and when they get to one, they will act on it, wrong or not. Many get mad just having to answer a call and planting or setting up people is not beyond them.

If you are poor or a minority, you go to jail, period. If you have money and clout, or know someone, well, it's never heard of or you get a slight rap on the hand and a don't do that again, it's hard to keep covering it up

This is so sad and happens more than we hear about.

It also upsets me because there are some really good cops out there who are smart people and do good work. They get a bad rap because of idiots like this.

and she is a kid...... 3 cops? wow... just wow....

THEY JUST GRABBED HER AND DID NOT SAY ,THEY WERE THE POLICE ......GET THEM FOR AN ASSAULT OF A MINOR......PLUS NOT SHOWING ANY BADGES .....THE FATHER COULD HAVE SHOT THEM RIGHT THERE........

Like I said there the fact that they then went back to arrest her at her school for assault was a clear attempt to intimidate.

They ought to be fired.

I know this thread is about Police incompedance, but the problem stems from somewhere, then again it could be Klan Related,however Texas,Lousiana,Mississippi,Florida are all Bush Country where it is against the law to Vote while Black...

A funny storey about one of those Mississippi Cops, I was on The Train to Tucson Az. one day and there was this short guy in Plad Pants, a Hawaian Shirt and two diffeent shoes of the train and I just had to ask this guy what happened to him???

So this guy tells me that he went to a Police Convention in San Francisco Ca. and when he checked into his Hotel Room and went to take a shower, someone came in and threw all of his clothing,wallet, everything in the Trash and left...

So, as this guy came out of the shower, there he was Butt Naked in San Francisco, NO MONEY, NO ID,and NO WAY HOME...

This is a Cop, A Mississippi Cop, all I can say is that he got no better than he gives, on a train in plad pants that don't fit,a Hawaian Shirt with 1 button a goofy hat to cover the bald spot and 2 different shoes...

Now you were wondering about Justice for these Texas Cops, well they may never see it in Texas Courts, but worry not, it will catch up to them sooner or later...

while i'm at it, might as well add Insurance Companies to the list, they have a law here that you must have insurance, but yet again, you have a clause for uninsured motorist coverage

I wish that each of you that hate police officers could walk in their job for a month..to see what they deal with every night..I don't know all the facts in this case, and if they acted outside of the guidlines, then they should be punished. Taking a snapshot of this and listening to the spin of people that are biased, make it difficult sometimes to see things as they are..not as they seem.
