The act of putting someone into a squad car, or putting them in handcuffs, by definition, is arresting them. The door can be opened, or the cuffs removed without any charges being filed.



I though you had to have your rights read when you arbeing put under arrest.... no?
no....actually you are read your rights when you are being charged.
all that is trivial though, they had probable cause, YOU need an attorney now !!!!
more than likely the charges will be reduced or dropped!!!!



I cannot afford a lawyer unfortunatly.... I am trying to gather information and literature to better prepare myself.
ok a good attorney wont let this go to court....it will be plead out with the states atty.
100-500 dollars
fine2000-4000, raised ins 10,000.incarrceration lost wages you cant afford not to

That is an expensive lesson to learn on Drinking And Driving. Would have been cheaper to get a Taxi. Wish you well.

def! I had no intentions of ever being a Drunk driver..... if i knew that the three drinks in three hours would put me over I would have never driven!

Well thats just part of it, I was charged with a DUI after leaving the bar, i only had 3 drinks in three hours! I didn't know the area very well and looked down for a second and hit a curb. Because I didn't do any damage I kept driving. They pulled me over and arrested me, charging me with evading and a DUI....... heres the catch the legal limit in CT is .08 I was .085.... they also didn't read me my rights til after I got to the station..... I just wanted to find out if they can charge me with evading since I did no damage....
.......the answer is YES!

even the greatest atty's will not defend themselves....YES!!!

ok look at this.....085 right???
if you were stopped at 10pm and they drew blood at 1 am your bac was on the rise. it takes time for the alcohol to get into your blood.
therefore you may not have been impaired when they stopped you, but you were when they tested.
thats an easy to prove.......get an atty....Take a loan if needed. otherwise its on your record for 10 yrs. the high risk ins will be 100 times higher than your atty.

Well thats the thing I was stopped at 12:15am, administered a breatlyzer at 12:50am, which was .085, then administered a breathlyzer again at 1:30am and the results were .07.

....nope. Public safety issue. Don't have to read you your rights until its safe to do so. Can hold you for 24 hours before charging you or when its safe and practical to do so.

I would take out a loan but my credits screwed, and I am working two jobs just to be able to enjoy my life.... WTF!

In CT refusing a breathlyzer is an admission of guilt, the penaltys are worse!

Ct has the stiffest laws on drinking and driving. They even advertise tv commercials on how much is too much. Soooooo don't pull the "I didn't know" on your judge. That will fly like a lead balloon and get you a lecture on ignorance of the laws. Protect yourself at all costs. Seek legal counsel now. That 2500 to retain a dui lawyer will save you 10000 dollars in the next 10 years. I'm not joking.

Idk about now, but a while back it was the same in KY. I had to read the book and take the DL test, and was shocked about that. They could automatically suspend your license for refusing to test on the spot. If you agreed to the test once you were taken it, and passed it would be restored though. But there is not enough time between to seek council...so that seemed a bit harsh to me.

Ky seemed strict anyway, cause to drive under 18, you had to keep a B average in school and dropping out was an automatic suspension of driving privileges. Wow!!!

Driving is an issued priveledge, not a given right. This is not a debate. This is about your future. A public defender will plea out and still make the charge stick so the state still gets your money and lots of it. Get a dui attourney.

how do I get money for something like that, where do I find a lawyer, I've never had to do anything like this before!
