Amen to that......and if he or she should be anywhere near a window, make darn sure you drag them in through the window to be inside too prove your point.

AULT - Richard Hammock loved his two dogs and cat so much that every night he fell asleep cuddled up with them.

He and Mojo, a lively miniature pinscher, had a game in which they ran around a backyard tree with Mojo yipping at what the family called "his invisible squirrel," a game that delighted both Hammock and his dog.

On Sunday evening, Mojo's barking became the center of a deadly dispute between neighbors. The dispute left Hammock, 48, dead from a 12-gauge shotgun blast to the chest and his neighbor Eric Griffin, 33, in the Weld County Jail on suspicion of second-degree murder, Ault Police Chief Tracey McCoy said Monday.

Richard Hammock, 48, died Nov. 2 from a shotgun wound. His dog had been shot with a pellet gun and he went to his neighbor¹s house to confront him about the incident. Hammock was carrying a three-foot club when he went to 33-year-old Eric Griffin¹s home. The district attorney says Hammock broke out the glass on Griffin¹s front door and then Griffin shot him.


Griffin was arrested for the shooting, but district attorney Al Dominguez says he can't prosecute him because of the court's interpretation of the Make My Day Law. He says he believes it was a mistake for the state Legislature to pass the law.

i like the idea of the law

but there should not be a free ride on murder of a neighbor

Just my personal opinion here:

I think the law is good and valid. IF, in this case, Griffin did shoot the dog with a pellet gun - it still does not give the right to interrogate him on the matter by bringing a club and bashing his front door glass in.

And honestly - I *would* prefer to be judged by 12, than carried by 6.

I think anyone that would defend their family and themself from harm likes this law. (I have many friends that live in Colorado that have told me..."This is the best law ever"):wink: :wink:

If you show up at my house with a club and maliciously break out my window, I'm going to blow you in two no matter what you're motive. If you are going to be judge and jury on my property, and threaten me and destroy my property, then you must think that is fair. This doesn't justify anything the shooter did to the guy's dog at all. But I support this law completely.

If you show up at my house with a club and maliciously break out my window, I'm going to blow you in two no matter what you're motive. If you are going to be judge and jury on my property, and threaten me and destroy my property, then you must think that is fair. This doesn't justify anything the shooter did to the guy's dog at all. But I support this law completely.


i can agree with that

he should not have taken the law in his own hands

but he was not in the house yet

i live here in colo. i would have blown his azz away too. its a good law and works well here. many cases of homeowner justified shooting

I think they should give all Americans guns...not only will it help reduce the population but it will do wonders for cleaning out the shallow end of the gene pool....

one note i am not arguing against the law

it is the no questions asked part

which appears to be a misconception anyway

ok let me ask this

say you go out to have a good time
you meet someone

things are going good

and you are both enjoying each others company

so YOU decide to got to their place to continue the party

and things seem to be going well

but something happens

and now THEY are upset

you try to calm them down thinking it is nothing major

they say hang on a second

they go in t the other room

all upset cause they think you are trivelizing their feeling

and come out with a shotgun and blow you away

as the law is stated in the opening post

to bad you should not have been there

To any law, there will be unintended and very unfortunate loopholes and exceptions.

The law that says we must always stop at red lights is pretty much held up as a good thing, however, it does slow ambulances down trying to get through city traffic.

However - in your specific example - yes, there is a very good chance the person will get away with it, under "Make My Day" laws.

but - illegal or not - you are still a corpse.
