I was watching a movie, about a couple of drunk folks who made out, and after the woman said it was rape
my question is , is it possible for a guy to be inebriated and still perform? And if it is, how do you prove responsibility of either one, if they are both under the influence? |

Kinda depends on what you mean by "perform." I am assuming you mean achieve an erection. It's not absolutely mandatory for a penis to be erect, or fully completely erect, in order for it to enter a vagina. It's not absolutely mandatory for a penis to be erect, or fully completely erect, in order to ejaculate. An erection just makes it easier. Not to mention, it's not absolutely mandatory for a penis to be involved in order for it to be considered rape. how do you prove responsibility of either one, if they are both under the influence?
However the law defines what needs to be proven to show responsibility according to the judge's, lawyers, and/or jury's interpretation. "The law" is just a defining system. "You can't do X. If you do, then Y happens. If you do a, b, q, then that proves X happened. We say you can't do X, since we proved you did a, b, q, then you did X, therefore Y has to happen." Otherwise, outside "the law," it tends to take lots of arguing, sometimes petty, most of the time escalating. Basic human nature is to demand freedom without responsibility, the highest amount of pleasure with least amount of consequences. Ideally, people take responsibility for their own actions. Otherwise, groups have to come up with ways to force it on the individual that allow the group to continue to exist and function as a group, ways that uphold the groups values, purpose, and identity (culture). |

I's say maybe different for each ... who is more... both can be under the influence... sure... should could say no... if she is drunk ... but he can still holed his weight on her to preform... and be drunk ... and yes he can still rape her under the influence ... I can say I have been in that position... but luckily after kicking ... him in the B*lls he got the massage ... I look very pretty that night ... Holiday party at work ... but still he new was not right to come on to me... when I did not make the advances in the first place... and was under the influence ... and if I would have wanted him... I am sure we both could have had the experience ... both under the influence... what goes up must come down but if your talking about where the girls are out of it-> drunk ... and she does not really know what is happening becouse she is in and out of conciseness or past out ...that's rape ... same goes for a male situations also ... |

yeah, seems complicated
I have heard the stories of guys waking up next to someone and not remembering having slept with them. Which just made me wonder how anyone can be held responsible,, considering the thought that being 'under the influence' seems to mean the ladies are not able to have the wherewithall to give consent,, I just always thought maybe the guys shouldnt be expected to have the wherewithall to know or care if consent was given. ,,,short of violent or abusive force,,,,it would seem drinking should be an absolving factor for both parties. |

To answer the question on whether a guy can perform while being inebriated.
Yes, it's very possible. There's a reason why the term "Whiskey D*ยขk" was created. The other question about responsibility while both are intoxicated. There's not a sure fire way to give a response. My thought is, if she didn't say "No" or "Stop" before the act of making out or proceeding into sex. Then she was open to that happening. Regret the next morning doesn't constitute that the guy raped her. |

From what I understand, dick doesn't have to be influenced by the brain. He has a mind of his own! Most guys have erections first thing in the morning, before they are even awake.

If its wine..umm. I can still perform after one or two glasses but any more than that nope..hmmmm... okay I shouldn't say nope..but you're definitely going to have your work cut out for you.keeping me up...lol..
