Until the 38 states and AG's that promised to take it to court end up taking it to court on the Unconstitutional grounds. Then once it hits the Supreme Court (which has the Conservative Majority) it will get flushed down the toilet where it belongs.

well, anti drug laws were upheld, restricting what is put in ones body is not part of the constitution anymore than mandating who pays for healthcare, but I guess it will come down to popularity and the supreme court justices

it covers the commerce between governing bodies

not the commerce of the people

legal PROFESSONALS have legitimate points on both sides,, on the PRO REFORM SIDE,,this is the LEGALLY JUSTIFIABLE argument

indian tribe is an entity

it says tribe not the individual indian

thus the 10th amendment limits the power of the federal government when it comes to the regulation of commerce to the individual

it says nothing giving the federal govt the right to regulate the individual

any one can interpret anything to say anything they want that is why it must be taken literally

and if we bring the declaration of independence into it it would enforce this fact of no federal mandates towards the individual but gives the individual the mandate power over the govt

but arent YOU also giving your interpretation? it says nothing about federal government it says CONGRESS specifically, and again it doesnt specifically mention governments or individuals......not to mention the bill is used as a tax bill where people pay TAX FINES for not having insurance,,,,,,,much less harsh than other mandates imposed by the states, such as auto insurance,, driving without insurance doesnt require you to pay a tax,, its enforcable by JAIL

this mandate doesnt throw anyone in jail for not having insurance,, it will probably be argued as a tax issue (another privilege of congress) and on that basis could very well be upheld
