Also, jail is for people that have either not been convicted and sentenced to due time in prison(felony convictions of one year or more) or those that have been convicted of a misdemeanor charge(less than one year). Uhhhh...what?? I have several felony convictions....did a few weeks in jail, then convicted, then my sentence was run concurrent..all charges to be served at once...5 years probation. After completing 5 years and no tickets or any other thing happening...the time was dropped. The charges stayed. If they had been run consecutive...I would have had to do longer probation and paid more fines. Kat That's what the law is, but your judge, and the prosecutor gave you minimal jail time, and maximum probation, and fines. I'm talking about someone that cannot get out of the charges with a fine, ie.. murder, rape, burglary, or whatever else falls under the no-probation laws. Prison is for felonies, and jail is for either pre-trial, or misdemeanor convictions. |

They will take the felony and it automatically brings the other charges to felonies. My time run concurrent assured me having less real time served probation or otherwise. Had it been consecutive..I would have had more time be it probation or jail or prison. It totaled 15 years with ten dropped upon completion. If I completed my probation clean of any problems...nothing...if I had got as little as a ticket, it could have been picked back up and I would start doing 5 years. But, if it had been the 15 concurrent, I would have to run out 15 or do the 15. |

For the 5yr+3yr sentence in Illinois, the five year is done first, and we have the 50-85% rule. You have to do 50-85% to be eligible for parole. If you screw up, you may have to do the whole 5 yrs. When the 5 year sentence is completed, then you start the 3 year, and the same rules apply. It's possible, but doesn't happen often, that someone would have to serve everyday of those two sentences. If the crime was a class X felony, you fall under the 85%. If it was a class 2 or lower, you fall under the 50% rule. You also get credit for any time served in jail while awaiting trial. That's usually day for day. If you spent 6 months in jail, then you get one year taken off your sentence. |

FYI; I had one felony..(conspiracy to commit false pawn, 20 dollar vcr) add to it pot (tiny tiny amount in someones house), intent (seeds), paraphanelia (illegal use)(all came later, but added on)...all became felonies.

Bobby James Broomfield was a maintenance man who had fixed the victim's air conditioning before the attack two years ago. He illegally entered her apartment at Sanctuary Cove and assaulted her. "I will always see and feel the machete pressed up against my cheek," the victim said during the sentencing hearing, WPTV reports. "I will always feel the zip ties pulled tight around my wrists." Broomfield was found guilty of seven charges and was sentenced to four life sentences Thursday. read this in this mornings paper, this is a very heinous crime and again so I am not misunderstood, I am not condoning any illegal activities but questioning our justice system and always trying to learn how it works. Since so many members here have more knowledge than I regarding it, I ask in the forums. How are the sentences for any crimes calculated? I believe they are categorized whether Misdemeanor or Felony and what class they are?Are there set minimums/maximums for each charge? Is the jury able to add/remove years from sentencing or do they just make a recommendation. Does this fall solely on the judge? Depends who he knows, know the right people and you get the minimum sentence...don't know anyone and you get the maximum. pretty vague care to expand? It's all politics, if you know someone high in the chain of politics you can get away with anything. If you are willing to work with law enforcement while having these "high" friends, you are golden...I'm noticing this a lot in Illinois, if you have clout you will be alright...if you don't know anyone you get max sentence. Had this guy known someone high up in the chain of politics his sentence would have been far less than what he recieved. |

It’s not necessarily who you know. It’s also what you can get away with claiming. The s.o.b. that took me just claimed a bunch of mental crap and got off with a slap on the wrist and “help with his mental health issues.” The system sucks and there is rarely any real justice.
