I got a question and I'm only asking cause I'm curious. I've noticed that you keep mentioning how many people have viewed your thread, and you have responded to all of the positive replies, but the few people that have voiced their opinions saying something not in support of your decision, you haven't said anything to them. Why is that?

To be honest, because she is wrong...she knows it, and doesn't want to accept it. The case is not going to see court, it is outlined in their contract here: http://www.7-eleven.com/Careers/SalesAssociate/tabid/143/Default.aspx that you have to be able stand for extended lengths of time, it is like me going to apply for an attorney job with no schooling and then turning around and sueing for them discriminating against my education...won't go anywhere.

well my opinion... maybe 7-11 is or does hire in their offices people that cant do all the job duties that the position in the store calls for.. i beleive they should of given you an application though no matter what.. and as far as teamwork i have to agree with lilbug.. teamwork is not one doing someone elses work for them... but sharing work.. and i very rarely see 2 people working at 7-11 at once usually just when they change shifts.. i know for me if there are duties that i cant do i dont apply for the job i go on and find something i can do...

Well I have read this post on and off and did find the original post as well. Myself I work for a construction company and the guys we hire in no way could be disabled now is that discrimination? To those that are disabled sure they would see it that way but the within the laws it is not. For if you go apply for a job and that Employer has a job that has to be performed there are certain qualifications you must be able to do and if you can not perform the job as needed on your own without any help then it is not discrimination.

I'm sorry for the way they might have addressed this issue to you at 7/11 and yes they might have said things the wrong way. But in the long run you have already admitted here there were certain duties you could not perform with out help.

Now I have known those that worked in the Convenience Stores and it is not all sitting behind a counter ringing stuff up. They must be able to lift up to around 40 lbs, they must be able to do all the stocking, checking the gas pumps outside when there is a problem, among other duties as well. At times they are in the store alone and must be able to perform all of the duties that are needed.

One can not expect someone to hire them and figure that what ever it is you can not do they will put it off on to another employee that is not fair to them to have to do their work and someone else,s in the long run.

I feel for you and what happened but I do not agree with the actions being taken in no way.

By the way I have searched and found the Colorado Laws on Employment I will post them below. Please take note on the Handicap Law as well. I have made that area in bold for all to read.




(1) It shall be a discriminatory or unfair employment practice:




(a) For an employer to refuse to hire, to discharge, to promote or demote, to harass during the course of employment, or to discriminate in matters of compensation against any person otherwise qualified because of disability, race, creed, color, sex, sexual orientation, religion, age, national origin, or ancestry; but, with regard to a disability, it is not a discriminatory or an unfair employment practice for an employer to act as provided in this paragraph (a) if there is no reasonable accommodation that the employer can make with regard to the disability, the disability actually disqualifies the person from the job, and the disability has a significant impact on the job. For purposes of this paragraph (a), "harass" means to create a hostile work environment based upon an individual's race, national origin, sex, sexual orientation, disability, age, or religion. Notwithstanding the provisions of this paragraph (a), harassment is not an illegal act unless a complaint is filed with the appropriate authority at the complainant's workplace and such authority fails to initiate a reasonable investigation of a complaint and take prompt remedial action if appropriate.

I've been telling her this for the entire day, let her waste her money since she won't listen to sense.

I'm in the middle of my own discrimination case and I'm not sure how I feel about this one.

actually any lawsuit that she may have has nothing to do with a disability......
the state will reprimand the company for equal opportunity...~~~~~they must provide an application to anyone~~~~~~it does not mean she will be hired.
on the other side.....was the person she talked to a manager????
if so case dismissed......no paper app was needed, because she was given an on the spot interview.
this point of law has been brought to you by wolf........that will be $49.95 for anyone that reads this!!!!bigsmile

Probably not given the state guidelines on employment...not that anyone listens to the guy that actually works for 7/11, but either way...
