So I have a family member that was convicted of a felony over 16 years ago. It was a non violent felony he did with some friends when he was 17. He admits it was stupid. He did his time in jail and has never commited a crime since that day. He is dedicated to his family, minds his own business, and works hard everyday. But now he is going to lose his job he has been at for over a year now because of his felony. He had told them about it, and the requirement then was he couldn't have a felony in the last 10 years. He passed the background check and passed and all was well. Now they've changed their policy to not having people work there that has EVER been convicted of a felony. He has done an excellent job there, never had any problems. Now they say he can't work for them anymore bc of something he did 16 years ago.
I just don't think he should have to pay for that mistake for the his of life. Can't a person redeem themselves??

He'll have to contact a criminal attorney and move to have the infraction expunged from his record. That's about the only way to ensure that it'll be out once and for all.

Being that it isn't a violent felony, it shouldn't be that hard... just a buttload of paperwork and B.S. on the part of the attorney.

He should be able to check with a Labor Relations Board in his state. He has rights. Maybe he could even be grandfathered in.

This use to be a country for second chances. Unfortunately this has changed to. We need to take back our government and reset many of the laws that are not accurate anymore. This will only work if the people want it.

Yeah! It's called paying your debt to society. Once you've done our time, it's suppose to be over.
I would try a lawyer about this one.

Of course he has redeamed himself. He may have to find a meanial type job for a few years until this goes away.
He may consider selling cars.

I called an attorney about it... they said he can't get it exspunged. There is literally nothing he can he do unless he wants to write the Gov and ask for a pardon. Which even if its granted, which is almost impossible to get... the felony still stays on his record.

at my job i do background checks all day everyday.... sometimes it is sad too, because we do not rent to convicted felons under no circumstances... violent or not. Alot of people do not understand that, but it gets more complicated than did the crime, did the time attitude for some people.

but with this policy, how are people supposed to move on with their life? I mean just bc you did something stupid years ago shouldn't mean you aren't entitled to having a place to live and a job to support yourself.

that's not true....in GA at least...my ex did some really stupid things as a youth...2 nonviolent drug related...govenor pardon cleared off reported record totally...took us two yrs of letter writing and political contacts I had....pain in the azz....something doesnt seem right with them changing policy midstream either....should not effect him....as I said though...I know GA laws...best wishes though, its hard

I could understand this a little more if it had been a violent felony. No one wants a violent felon as thier neighbor.

I contacted 3 attorneys, not one of them said it could be done. They all said we could "petition" and keep trying... but he couldn't promise anything

Our system is flawed this is nothing new. I say forgive, and forget. He should be immune to this new rule seeing as he passed the check, and was hired in before it. I would seek legal action for sure.

I do understand everything that you are saying, but there is so many laws now that govern both sides of the convicted felony do's and don'ts..... I have worked in the management side of Real Estate for 10 years now, and every year something new comes along.... Some new rule or law that we have to do by. I work for 2 Attorneys now, and thank goodness I do, because rules/ law change everyday. Like I said it sucks sometimes because when you have a person come in your office that is a convicted felon, and they have no where to go with children, that stays on my mind, not noone elses.

I completely understand what you are saying.

It happens all the time, and I am sad to say he may not have too many options.
Have him put in applications everywhere.
He may have to take a job that he doesn't like, but he needs to take some sort of job and just stay with it.
It could turn out to be just like his last job, but you never know.
He just has to keep his head up as hard as it is.
