well actually the state wanted me to pay 200 a month but she went to the courthouse and lowerd it for me some which was nice of her but her daycare is 800 a mnth so i pay 400 of it and the rest is for clothes and food That's really nice of you, but I think you should stop paying the extra and only pay what the court says. If your child needs clothes, then go buy them yourself. I'm a single mom and would never take advantage of my sons dad. |

Hello, as far as the tax laws go. I do know that on your federal return, if the CUSTODIAL parent signs a form and gives the NONCUSTONDIAL parent permission, then, you can claim your child. If your ex-wife doesn't sign it, sorry, you can't claim her. In the eyes of the government, it doesn't matter who pays what, unfortunatly. Maybe you and your ex could work something out. Alternate claiming her. You have her one year and she have her the other.But again, that form needs to be signed. When you go get your taxes done, just ask them, they will give you advice.

Actually, it boils down to who turns in the return first. The IRS does not care about the divorce papers. The state with have an issue but the Fed's don't. I have full custody and my ex files every year and claims both of the kids. The divorce decree states that I get to claim them. I went back to court to have it enforced but feds don't care and the state has no jurisdiction. Just remember that its JUST money and spend your TIME with your kids. Its far more valuable!
