IMO

If you plan and carry out a murder ( or murders), you had the time beforehand to think about your actions and the ramifications of those actions. You chose to kill.. to take another's life. Which is premeditated murder.

And I feel that anything short of mental illness would then qualify you for the death penalty.

Only if the executioner is chosen at random from the population of their peers like for jury duty, is fully aware of all the evidence, and can go through with the actual execution.

And if that guy can't execute them, then their personal tax rate goes up in order to offset the costs of life imprisonment.

He shot at least 5 law enforcement officials, 3 of his overall victims have died at last count. Why didn't the cops shoot this bastard to death where he stood? Did he not prove to pose a threat to officer safety? Did he not prove to pose a threat to public safety?
