I 'said' nothing here about entitlements,, try to stay focused on the topic at hand,,, declaring a breech of contract isn't the question, the question is what should (reasonably) CONSTITUTE a breech of contract,, Entitlements, your normal discourse on why somebody should have something, relevant to the conclusion of why you would have a problem with a constitutionally sound law and not an unconstitutionally invalid law, entitlements. And as to what would reasonably constitute a breech of contract, a breech, violation of the terms, non-performance. All the same. Now if we go back to entitlements, then you would have a problem understanding reasonably. |

Call it the biggest Facebook mistake ever. A daughter’s snarky status update has cost her father the $80,000 settlement he won in an age-discrimination lawsuit. According to the Miami Herald, Patrick Snay, 69, was the headmaster at Gulliver Preparatory School in Miami for several years, but in 2010, the school didn’t renew his contract. Snay sued his former employer for age discrimination and won a settlement of $80,000 in November 2011. The agreement contained a standard confidentiality clause, prohibiting Snay or the school from talking about the case. However, Snay’s daughter, Dana, now at Boston College and a part-time Starbucks barista, couldn’t resist bragging about the case on Facebook. “Mama and Papa Snay won the case against Gulliver,” she wrote. “Gulliver is now officially paying for my vacation to Europe this summer. Snay is now headmaster at Riviera Preparatory Academy in Coral Gables. He is allowed to file a motion for rehearing and also appeal to the Florida Supreme Court. However, the odds of Snay's winning his money back are slim, according to attorney Bradley Shear. “It depends on the terms of the confidentiality contract; each one is different, but the damage is likely done,” Shear tells Yahoo Shine. “Some confidentiality agreements stipulate that the client cannot tell people who are not involved in the case: others prohibit anyone from knowing. Facebook is a public forum, even if her profile is set to private, and that’s where the mistake was made.” Had Snay’s daughter been discreet, the court would not have discovered the family had violated Snay's contract. “The bottom line is, when involved in legal proceedings, don’t disclose anything on social media,” says Shear. “It’s not worth it.” Oh, and that European vacation? Hey everybody!!! First time in a year that it has rained on consecutive days in SoCal!!!! There is a God!!!!
I am not a Laywer nor any other expert. What I do posses is a vast amount of experience in communication. In this day and age, is anything a secret? And our government is still trying to keep things hush hush. The only time government can hold secrets is when it has to do with the countries security. And that has now gone to the wayside because of the 9/11 cover up. The man is old. He worked. Give him his money. As for lawyers and legal terminology... Anyone on this planet can defend them self verbal if they take the emotion out of it and listen, really listen to the other person or side. Communication: Movement, objects, speech, and words We communicate through gross symbols. We call them objective. The only thing we cannot escape is our point of view. Let it RAIN BABY!!! RAIN!!!! |

The law is probably pretty clear on this, and if the daughter violated the confidentiality agreement that she had signed, then her dad does not have much of a case. There are some other factors as well, involving the social media piece. Was someone in the company monitoring this girl's Facebook page?

Makes contract null and void, but good news, he gets to keep the $10,000 in back wages. |

Can you tell me where to find that opinion as in law you are allowed opinions so long as other before you have agreed and published their opinion in those thousands upon thousands of law books that fill floors and floors of shelves in a law library. And how often do you go to these law libraries? |

Not that I really care about your personal life, it seems uneventful, not worth wasting time on. However, your bs is of interest. I detest bs and will challenge it at every opportunity. So if you don't like it, you have the right to remain silent, you have the right to keep your opinions private, and your have the right to educate or not educate yourself, so long as you do it without thinking someone else should pay for it. Reasonable or unreasonable ruling? And you opinion is unreasonable, has been reasonably challenged, and unreasonably sidetracked by childish insults without any rebuts of the challenge. So I would guess that as it is not rebutted, it is accepted, UCC 2-207. And using ignorance of a subject to be projected as the right to an opinion based on that ignorance is purely astounding. But to maintain a posture of insult when challenged as a legitimate rebuttal is beyond comprehension. So please, when entering a contest of wits, come armed. |
