Oh lord I can't believe this. This is even more dangerous that what has happened up to this point... The article first sets the stage, that what is being done (stealing our rights) is ok, but they need to be stolen differently... "The fact that I happen to think the president is right on many of these policies does not alter the fact that I believe the means he is doing [it] is wrong, and that this can be a dangerous change in our system," he said. “And our system is changing in a very fundamental way. And it’s changing without a whimper of regret or opposition." And then another of these great arbitrators of that magnificent union comes up with: "Situations like this, these benevolent suspensions as they get more and more frequent and more and more aggressive, they’re eroding our citizens’ respect for the rule of law,” she said. “We are a country of law and not men. It’s going to render Congress superfluous." So it's the benevolent suspensions that is eroding our citizens' respect for "rule of law". And then the actual gall to state "we are a country of law...". But that only sets the stage.... Impeachment would "surely be extremely divisive within the Congress and the nation generally, and would divert the attention of Congress from other important issues of the day," said Rep. Jim Gerlach (R., Pa.). While he would be correct in one point, it would be a waste of time because of the current Senate, that does not mean it should be ignored just as a process of law. And what attention would be diverted from what important issues, serving the lobbyist? But wait, the important points are still to come... Gerlach, who testified before the committee, introduced H.R. 3857, the "Enforce the Take Care Clause Act," which would expedite the review and injunction process for federal courts to challenge executive actions. Such a challenge would have to pass a supermajority in both chambers in order to be fast-tracked. "Given the growing number of examples where this President has clearly failed to faithfully execute all laws, I believe it is time for Congress to put in place a procedure for a fast-track, independent review of those executive actions," he said. Gerlach said he proposed the bill due to Obama’s repeated alterations to his signature law, the Affordable Care Act. "The ACA has been revised, altered and effectively rewritten by the president and his administration 23 times since July," he said. "When we have these constant changes at the president's whim think about what that does to businesses' planning capabilities and hiring capabilities and their expansion capabilities," Rep. Tom Rice (R., S.C.) said. "We shouldn’t wonder why our economy is struggling." Rice has proposed the "Stop This Overreaching Presidency (STOP) Resolution" as a remedy. The resolution, which has 114 cosponsors, would direct the House to file lawsuits against four of the president's unilateral actions, including the employer mandate delay in Obamacare and deferred action program for illegal immigrants. Oh this is rich. The legislative branch wants to legislate with an act (requiring supermajority agreement for fast tracking) to be able to accelerate review and injunctive action through the judicial system. But wait, it gets better, the "STOP" resolution that would direct congress to sue. And in conclusion... Turley said Congress must take action to regain their power as the "thumping heart of our system." "The fact is, we’re stuck with each other," Turley said. "Whether we like it or not in a system of shared powers. For better or worse we may deadlock, we maybe despise each other. The framers foresaw such periods, they lived in such a period." We're stuck in a system of shared powers, only a lawyer could be so lame. How about we have a constitution. Within that constitution are enumerated powers, for each of the parties of that shared powers we are "stuck" with. But where in the constitution does any of this crap have a basis, it doesn't. In fact the constitution is very clear in this aspect... Article. I. Section. 1. All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives. Section. 2. The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment. Section. 3. The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present. Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law. Article. II. Section. 1. Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States." Section. 2. The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment. He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments. The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session. Section. 3. He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States. Section. 4. The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. Bingo, bango, that's the whole game. Section 3 provides the power and Section 4 provides the remedy. There is no rocket science involved. What you have is tyranny, first on the part of the Odumbo in his actions and second on the part of congress in their inactions. |

This is an issue that had been slowly building since President Woodrow Wilson and Bush pushed it along as well as the Left cried bloody murder but did little to stop it; now Obama has taken it to the next level as it's now the Right is crying foul.
This is the reason I don't care for the Demon-Rats or the Re-Pukes as they each take away the liberties of the people while pointing fingers at the other; wish that some more people would stand for the Constitution in Washington. |

This is the reason I don't care for the Demon-Rats or the Re-Pukes as they each take away the liberties of the people while pointing fingers at the other; wish that some more people would stand for the Constitution in Washington. They stand by it every day..... trying to figure out how to circumvent it! |

Oh it was going on long before Wilson, goes as far back as the Constitution Convention. But you are right in one aspect, it was Wilson that put the "paid in full" designation on things with his signing of the Federal Reserve Act. No good has ever come from that. |

They stand by it every day..... trying to figure out how to circumvent it! But we do need to rejoice because as every day passes, more and more patriots are awaking to the facts that only they can put a stop to the travesties of the government. The constitution is but a piece of paper, what counts are the words and the words do not count if they are not in the minds and hearts of the citizenry. We cannot depend on the politicians, it is by their very nature, their thirst for power that makes it counterproductive to their endeavor. After all it is the government that is at fault and their goal is to expand government and to that ends they have been very successful. It is but the people that will stand up, put their foot down and declare they are reclaiming their rights, then and there. Start on the local level, rid your county of tyranny. Turn in all your licenses for taking a right and turning it into a privilege by charging a fee and issuing a license is the very base of the removal of your rights. Murdock v. Pennsylvania, 319 U.S. 105, 63 S. Ct. 870, 87 L. Ed. 1292 (1943). It is contended, however, that the fact that the license tax can suppress or control this activity is unimportant if it does not do so. But that is to disregard the nature of this tax. It is a license tax -�� a flat tax imposed on the exercise of a privilege granted by the Bill of Rights. A state may not impose a charge for the enjoyment of a right granted by the Federal Constitution. And just as a side note, here is the Supreme Court by way of MR. JUSTICE DOUGLAS, delivering the opinion of the court, stating that it is a right granted by the Federal Constitution. And then the people want to place their trust in the government, especially lawyers. |
