i still say even from reading these things that it is not worth your child getting sick over to make them pay the bills.. that just cancels out the bills.. why should the child suffer?

So I live in Canada and I rent a duplex.

Now I have lived there for 13 months and there is now a fungus growing in the basement. My ex contacted the landlord about the issue by phone. Her response to this matter was "I am not suprised with all the moisture down there. I will deal with the matter when you guys move out." I then emailed her myself and told her there is now a second one growing beside her and that I would like her to get it inspected. I will also be going to city hall with this matter with the photos I have sent her as well. My daughter has been coughing alot lately and has been in the past the doctor said she is fine but I am going to bring this to his attention and see if that makes a difference. I then told her if she has any health problems I will be taking this matter into my own hands.

My neighbours also said they have what they think is black mold growing on the dividing wall. It keeps growing and she won't do anything about it either.

Does anyone have advice at all as to what I can legally do??


If it's mold, you can spray it with bleach, and it will kill it. Thats what we do around here anyway. We get it under the eve's, and under the patio out back, Bleach works good.

make sure u keep documents as well of when you called etc dr apts and all the paperwork... i once had a sliding glass door that had condensation on it so bad i had ice in my house stuck on the floor like 6 inches thick! well the linoleum.. stained gray from it.. and the landlord wanted to charge me! i had called the about it.. also i called them when the toilet was plugged for a plummer.. they were pissed! cost them 200 bucks<a duplex as well> i lived there for 2 yrs before this happened! they biotched at me and threatened me that if there were toys down the toilet from my 3 yr old and 1 yr old that i will have to pay... well guess what ? it was tampons! and they screamed and yelled at me for that one... i just said are you done yet?? well sorry about your toilet.. you just go ahead and try to charge me.. cause i dont have any company over and furthermore i can not wear the things! i was told by my dr that i cant. and that i had documentation that shows that so now if you want to continue on you may or i can dig for the papers if you would like.. that shut them up real fast!!!!!!!

i do not believe mold is a tenants duty to fix.. its a structural problem causing it.. and a health issue making it an unfit place to live.. its the landlords duty to fix the issue that is what rent is for.. and they are to fix it on a timely manner as well..

the first thing to do since the phone call did not work is to send a certified letter to your landlord.. stating that the home is not in livable conditions that you are concerned that it is a hazard to your health. and what the problem is. that way you will get a receipt that you mailed them the letter. and that they received it, they have to sign for it. print the pics right on the letter as well, i would get it notarized as well for a dollar so they see u are serious about this. so dont sign it till you go to bank or postal place such a mailbox etc.. then make a copy for yourself of it to keep for your records . find out how many days they have to get someone out there to check it out.. and write that in there as well..
