Quarter bag of weed = misdemeanor
Quarter bag of weed + scale = intent to distribute = felony Weed with intent to distribute + having guns in the house = felony posession of firearms Normally, with weed in the house, I would get off with probation and maybe a few days in jail. But because I had a scale, I must be selling. And because I have a few guns in the house (which were legally owned and never ever ever ever used for killing anything but old electronics), I must be a violent drug dealer. So I went to my arraignment hearing today, which was really nothing but resetting my actual court date. My attorney made a motion to supress the evidence, which he says has a 50/50 chance of happening. If the evidence makes it into court and I am convicted, the prosecutor wants to sentence me to 22 months in prison! What the UFCK?!?!?! So I smoke some weed. I've never in my life hurt a living thing. I have long since been out of past trouble, which also includes nothing but smoking weed. I've spent the past 6 years in school and am 4 classes from graduating with an architecture degree. I haven't smoked since the day I got arrested. I have completed all my pre-trial probation requirements with flying colors. And I have been nothing but helpful and the best of friends to all those around me. I am an exceptionally talented designer with a lot to offer the world of architecture after graduation. And now my $100,000 education along with all else I have done in the past decade are about to be thrown down the tubes. I'm so depressed right now. What the hell did I do to deserve this? |

Well you havent been sentenced yet, so try to keep positive.
I dont know how they can suggest that a quarter bag of weed proves you are selling, it is such a small amount. I have scales to, which i use to make sure what i am buying weighs up. Scales dont prove anything either. There is no way on earth a custodial sentence can be justified by a reasonable human being. |

Ignorance of the law is not a defense.
Rationalizing you are being given a bum rap because you are educated? Redonkulous. What did you do to deserve this? You broke the law. There will be mitigating factors, but you will have to plead guilty to a felony, chances are. Next time, learn the law. How did the cops "happen" into your house, anyhow???? |

What I don't see is how the law can rationalize locking up someone who is not a bad person at all because they own a couple guns. Not a snowball's chance in Hell I am pleading guilty to anything. Yeah, I did learn the law and as a result will never open the door for the cops again. |

Was the bag of weed visible on table when you opened door ? If so gives them probable cause to enter your home without a warrant.

Although I disagree with the laws in this state. Your likely to get sentenced to 22 months but released in 8 on good behavior. I thought every body that lived in GA knew drugs + weapons was felony.

Like others have said, think positive man. I have been in your place, wrong place wrong time, a few times in my life. Comes with my being Scooter Trash and hanging out with the wrong clubs.
