I would have to go with the one that the pet was closest to, basically let the pet decide.

This is hard if you havn't decided BEFORE you get the pet! I will not have anything owned jointly again unless I am willing to give it up. If I have a pet I will have it licensed in my name, I will pay the vet bills & this will hold up in court.

OF course if the pet is signifigantly more bonded with my ex & he is capable of properly caring for it I would let go.

Honestly would have to say the one that being with is in the best interest of the pet

1 - the pet is close to/likes.. there is a bond
2 - the one that has the time & resources to care for the pet properly
3 - the one that will do all necessary to maintain good health for the pet (vet, exercise, food, etc..)

In my case... all of them (2 cats, 2 dogs, 2 fish) all stayed with me.. and I would have put up on heck of a fight to keep them if I had too.
